Business leadership: Skills that Take to be a Good Leader

People often refer to leadership as a skill that a certain person has.   It is a kind of skill in which a particular person can make other people follow him without skepticism.   However, if leadership is â€Å"properly† defined, it is a process of accomplishing things through a person who influences people to work and deliver what it is that is to be delivered.   In addition, since not all goals that are set will be successful, leadership is an adventure.   In reaching goals, the person leading must think of various ways to accomplish all the things that they want to accomplish for there are times that they will fail due to an erroneous decision, or an error on the method or approach that they used.   When they fail, they are back to the starting point and will work on again by analyzing what went wrong and by formulating a new plan minus all the points that caused their failure on their first trial.Nowadays, people should be fully aware of the definition of leaders hip since this is particularly crucial and very prominent in every setting – from school, workplace, government, among others.   However, there are still people who are not familiar about what leadership really is; as said before, it is regarded as a skill that one possess that is why a particular person can make other people follow him of her. Moreover, it is assumed to be a quality or characteristic of a person.   Only a lesser portion of the population knows that leadership is a process that requires several skills and specific qualities from a certain person in order for him to be able to influence the people who works under him towards the achievement of a goal.Anyone can become a leader just as long as they develop the skills that are needed; moreover, anyone can lead even though they are not the president of the country, a coach of the team or a captain of a ship.   In other words, anyone can be a leader when the situation calls for him or her to lead others.   You do not need any badge or a prestigious office in order to be a leader.   However, if you are a leader you are not similar to a boss in every sense.   Bosses are usually known to be the people who always boss others and push people around. In contrast, if you are a good leader, you are not doing these things to the people under you.   Then again, a leader and boss may be synonymous if the latter does things by influencing empowered and effectual people.Leadership can take place anywhere and one particular venue is in the business sector.   In order for a certain business to work and succeed, there should be a number of people who will exert effort and do all the needed actions and tasks.   However, these people will not be able to work in a proper manner without someone who will lead them; otherwise, each would just do everything in his own way.   Business leaders or owner leaders should lead them on the right track on the way to success; he should provide everything that his team or employees will need, and also offer responsibility. The leader’s view of his employees will affect the decisions to be made throughout the process of accomplishing the goals, they should be aware of the responsibilities that they need to fulfill – the kind of responsibilities that employees are expecting to be fulfilled by their leader.A leader in a business establishment, like any other leader, has to deal with two things: the job at hand and the group he should lead.   These two aspects are essential in the process of leading a business entity; if there is a group but there is no job, a leader is not needed. The case is the same if there is a job but there is no group to carry it out.   The leader can also only tell if he led in a right way if they got the job done and, at the same time, the group is still held together.   If the job was done but the group was dissolved, the accomplishment and success are both useless because the leader who to ok charge of the job was not a good leader.   Any person who wants to be a good leader should know that getting the job done is not the only thing that matters.When it comes in being an effective leader in the business sector, one should have the important leadership skills, namely: honesty and integrity, competence and credibility, forward looking and visionary, inspiring and motivating, and good communication skills.   These five sets of skills are very significant in succeeding in any organization, wether the team is within the business arena or not.Honesty – meaning to be true and trustworthy – and integrity – which connotes acting in a just and honorable manner – are very essential skills in being a leader.   Your team should be able to trust you because without trust nothing will be accomplished.   Trust is the key to any effective employer-employee relationship.   In addition, all your actions must be logical and rational, not based on im pulse and sudden outburst of emotion but on the principles that you believe in.   Though being honest, most of the times, cause trials to the person who practices it, it is better to be truthful all the way so that your team will trust and follow you for they will believe that all you will say are true whether those words are positive or not.   For an instance, if an employee delivers an unsatisfactory job, you should tell him in all honesty that you are expecting or needing something more that what he had presented. While the employee may feel bad the criticism may help him do things better, and will contribute to having a quality result in the end.The next set of skills are competence and credibility; competence talks about being appropriate to a certain job or task while credibility refers to being reliable and trustworthy.   If a person wants to be a leader, he or she should be competent to lead other people; he or should have the capacity to influence and convince the tea m about the things to do and the decisions to be made.   Being a leader demands a lot of responsibility and comes with a lot of pressure, a person in order to lead must be able to keep his composure whenever the situation gets out of hand and stressful, otherwise, he, along with the team, will go downhill.In addition, this person should have all the abilities, experience and expertise to lead, these factors will lead to being trustworthy for when the people he or she will lead see that he or she knows what he or she is talking about and he or she has the full grasp of the goal and all the situations then they can trust him to lead them.   Just like when reading a book about new innovations in the medical world, people will only buy and believe it if the person who wrote it is an expert. In as similar vein, a leader should have enough background about the task at hand so that the people will see if he or she definitely knows what he or she is talking about as a subject matter exp ert.Thirdly, a leader should be forward-looking which means he or she should has his or her eyes on the things that might take place in the future, this is a necessity in order for the leader and the team to be prepared and alert of what is to come whenever they make a decision.   The leader should be the first to see the consequences of each of their actions and consequences in order to avoid mistakes and failures; he should evaluate and study every situation and option presented to him or her carefully before choosing and making a final decision.   Additionally, being a visionary is also important, with this characteristic, a leader has a specific and precise vision of what he wants in the future, it is here that the goal is formulated and this vision is what will keep them on track.   If the leader has a vision to have his company the leading business firm in the country, all of his actions, decisions and moves will all be towards this vision, without any kind of vision, th en there is no goal at hand to be achieve; thus, there is no reason to work at all.Subsequently, a leader should be inspiring and motivating.   Inspiration and motivation are two important factors in order to have a drive to work, a leader should inspire and motivate his team to work for the goal they want to achieve.   An effective leader should not only give his or her team the things they have to do but also the reason why they should do them, he or she should provide them the purpose of their tasks and, of course, their goal.   Inspiration and motivation are very important each and every one of us; an athlete cannot get himself to perform his best when he lost his motivation and a writer would not be able to write a bestselling novel without any inspiration.   As a leader, you should remind your team to believe in themselves, this also means that you must have the drive, determination and spirit for these are what you need to motivate them.Last but not the least is that a leader must have good communication skills.   In order to lead, a leader must communicate to his team for that is the only way for him or her to deliver them the instructions, to give them inspiration and motivation, to be honest to them, to convince them that he is credible to lead, and to share to them his vision.   Good communication skills and leadership go on together, if you can be a good communicator, you will be able to express yourself very well, both thoughts and feelings.   You have to establish good and effective communication with your team in order to convey not only words but also meanings.   In addition, if you become an effective communicator, you will be able to project a confident and sincere image that people likes to see in a leader.   You should maintain good communication with your team; otherwise, you and each of your employees will draw into isolation which will bring negative effects on the business because it can cause in making wrong decisions .In the next four or five years, I would want to develop these skills in order to contribute to my success, particularly, honesty and integrity, competence and credibility, and good communication skills.   These three set of skills are, in my opinion, the most essential in becoming an effective leader, for that reason, these are the skills that I will focus on developing in the next four to five years.   Honesty and integrity are very important because it is through these that trust can be build and establish.   Developing honesty is not easy because humans are subject to lie most of the time intentionally and unintentionally due to their nature.One particular reason why we lie is because we do not want others to be hurt that is why we resolve to saying â€Å"white lies†, however, in the business realm, these lies and other kind of lies should be avoided because covering negative things with such will affect the result of the job.   In order for me to develop honesty, I must learn to say truthful things and also learn the proper way to address them especially those negative matters so that people would not be hurt and for them to see for themselves the aspects that they could work on the aspects they should work on.   On the other hand, to develop integrity, I should learn to focus on my principles and be able to control myself in order to act rationally not based on my impulse and sudden emotional outburst.   Through this, I will be able to avoid acting unjust and harsh towards other people.The next competence I want to develop is competence and credibility.   To develop these two, I must gain a lot of experiences in order to expand my competencies and credibility.   I must learn to take responsibility for a lot of things, and to handle different kinds of situation and, as well as, pressure in order for me to be considered as competent.   In addition, I should acquire the necessary qualities and attributes such as charisma, communicat ion skills, confidence, and responsibility to be competent enough to be a leader.   On the contrary, in order to be credible, I need to study the things I need to learn regarding the task at hand, since I am planning to enter business, I must equip myself with the appropriate knowledge on how the business world works and about the certain business I would enter to so that my team will look at me in a way that I perfectly know what I am talking about and what I want to happen.  Lastly, I would want to develop my communication skills because I believe that communication is the most important thing between the relationship of an employer and an employee.   Without good communication skill, I would not be able to convince them to work for me, I would not be able to share them my vision and the plans that I have in order to achieve our goals, and I would not be able to tell them what I have in mind or if they are doing the right thing.   It is only through communication that will I be able to inspire and motivate them to do the things we have to do.   Most relationships fail due to lack of good communication, which is why for me this is the most essential skill in becoming an effective leader.My team should always hear me out in reminding them of our goals and in briefing our plans. Without communication, they would not do the things they have to do and worse, they will just move according to their own way.   If that happens, the job would not be accomplished and the group will not stay intact.   The process of leadership can only be considered a success if the job was done and the group still stays together as a cohesive team.Some of the most influential leaders in the history have all the five important leadership skills, especially the three that I have chosen.   Queen Elizabeth II of the Great Britain held the British monarchy and institution with a steady hand which is why they remained solid throughout the time she was placed in the throne, sh e understood the needs of reforms and even opened her accounts to the public in order for them to see that they are one with the people when it comes to decreasing the costs of their lifestyle.Then there is also Arnold Schwarzenegger who was elected as the governor of California, people may raise their eyebrows or have already raised them when he ran and won the election, but he is a visionary and this was evident on the economic policies that he have imposed on California in order to reduce the effects of global warming, he is also the one responsible in restoring the state’s environment – he have reduced the pollution in air and water, and even restored the habitats for the animals.   All these measures were done for his vision of making California acquire electricity on natural sources like wind, biomass and sun by the year 2020.Likewise is in the case of President Hu Jintao of China, who aims to get through the economic and social tensions rising in the country t hat was brought by the country’s growth for he wants to build a society living in harmony.   He was the one responsible of China’s rapid growth in the international world economically; he also radiates an aura of a knowledgeable, intelligent and confident leader.   Also, if there is anyone who had a lot of pressure and stress in leading, it could be Mayor Michael Bloomberg of New York City who needed to rebuild the city that never sleeps after the unforgettable nightmare of â€Å"9/11† – this is what competency is about.While in the world of business, Bill Gates, co-founder of Microsoft from the year 1975, dominated as the world’s most influential business leader.   He has the kind of determination that he used in his leadership that led to the change of the face of programming and information technology.   Dropping out of Harvard University did not seem to become a waste as he is now one of the world’s richest men.   And there is also Steve Jobs, co-founder of Apple, who is responsible for today’s most hyped gadgets.Being a leader is not impossible for anyone of us, we may be born with the potential leadership skills, and all we have to do is to develop them to become an effective leader. The five sets of skills I have discussed are really important to become an effectual leader.   Leaders should be honest to everyone including himself; he should have integrity, the competencies and credibility to become one. He should provide inspiration and motivation to give his followers the drive to work. He should be forward-looking and should be a visionary to be prepared and focus of the future. Lastly, he should be a good communicator to convey all of these to his team.   Being a political leader or a business leader necessitates all these skills; one may just need to adapt one’s focus as applicable in the setting where one is expected to lead.

External & Global Environment of Louis Vuitton in Japan Essay

Introduction This case study is on the external and global environment of Louis Vuitton (LV) in Japan. For many years, Japan has been Louis Vuitton’s most profitable market but the economic crisis has had a negative effect on sales; sales have declined in the past few years. According to Tokyo Fashion News in November of 2008, LV has â€Å"seen more than a 5% decline in sales in Japan so far this year† (para. 3). They attribute the decline to one of two things, the decline in the Japanese economy or that LV has fallen out of favor with the Japanese people. Synopsis of the Situation With a decline in the economy, Louis Vuitton has been forced to open stores that offer a lower priced collection. The Japanese economy can no longer support the high-end collector name brands that it used to but Japan is in love with LV. â€Å"Based on sales figures and brand image indicators, we have compiled Asia’s Top Ten. It confirms what every luxe-loving Asian already knows: There is nothing to beat the charms of Louis Vuitton and Rolex† (Chadha, R. & Husband, Paul, 2006, para. 5). Key Issues The number one key issue would be the decline in the economy. The second key issue is that the Japanese are looking for a good deal, good value to product. The third key issue is the number of competitors in the Japanese markets that offer luxury products. Define the Problem In 2008, the economy in Japan and all over the world took a nosedive; people  were worried about making ends meet and severely cut down on buying luxury items. People started looking for products that offer a better value for their yen and became more cost conscious of what they were buying. There is serious competition in Japan for the luxury market. Among the competitors are Rolex, Cartier, Gucci, Chanel, and Prada to name a few (Table 1.1). Alternative Solutions One alternative solution would be to create a less expensive product and market it to a larger segment of the market. A second solution would be to improve the quality of their product and continue to market as a luxury item. A third solution would be to offer a middle of the line product available online that would draw the customers away from the other luxury item companies that would not require a storefront. Selected Solution to the Problem The selected solution to the problem would be to offer a middle of the line product available exclusively online. By offering the products online the company would not be require to have a physical store for customers to come into. This would cut costs dramatically; there would not be the overhead of operating a store, paying employees, or paying the costs of running a store. This would also offer customers the convenience of shopping from home. Implementation Implementation of this plan could be tricky. The company needs to make sure they have the capacity to handle a large volume of internet orders and they need the inventory on hand so they could ship items in a timely manner. Probably a million small details will need to be dealt with so the company needs to do some brainstorming with employees and management as to what problems may arise at implementation. Being prepared for any unforeseen problems would be very important before implementation, do not wait until problems arise to brainstorm solutions. By making sure they are prepared for orders, word-of-mouth advertising could be a huge advantage. Secondly, the company would have to make up a great advertisement campaign targeting the middle-class and the products that would be available. Recommendations Louis Vuitton should start a marketing campaign focusing on the middle class in Japan offering mid-priced products that are available exclusively online. The company should focus on smaller, out of the way cities first that do not have access to the higher priced stores and move out from there. Depending on the success of the marketing campaign in the smaller cities, the company should move to the larger cities where they have stores in order of population starting from smallest to largest. If these campaigns are successful, they could consider moving outside of Japan into China. Conclusion While Louis Vuitton is very popular in Japan, the decline in the economy has affected sales. Because there are so many other luxury stores in Japan, the company should focus on the larger, middle class segment of the population. By offering a lower priced, quality product the company could gain market share by attracting more customers from a larger population of people. Breathe Tim Winton Essay

Let me begin with a caveat. My argument is based on the evidence of fiction, on a discussion Tim Winton’s most recent novel, Breath. Social scientists may suspect this kind of evidence and see ‘fact’ as more trustworthy than ‘fiction’. But even though it is true that the evidence I will be presenting is not based on people and situations in ‘real life’ — whatever that may be — I would suggest that fiction may take us to the sources of social awareness and action, to the extent that, as Levinas1 suggests that awareness and action may originate in ‘gropings to which one does not even know how to give a verbal form†¦initial shocks [which] become questions and problems’ and thus takes us into the dimension of ‘the archaic, the oneiric, the nocturnal’2 which (as Levinas goes on to argue) has ‘ontological reference’ because in it we are able to live ‘the true life which is absentâ €™, a life, moreover, which is not necessarily ‘utopian’ though it refuses ‘the normative idealism of what â€Å"must be’†. I want to argue that Tim Winton’s recent novel, Breath,3 provides this kind of understanding and that it is one which may be particularly useful in our reflections on the relationship between family, society and the sacred — at least if we take Levinas’ further point that ‘the social does not reduce to the sum of individual psychologies’ but represents ‘the very order of the spiritual, a new plot in being above the human and the animal’.4 First of all, then, let us look at the society in which the novel is situated, a small mill town not far from the ocean in south Western Australia. For the two adolescents, ‘Pikelet’ and ‘Loonie’, the central characters, it is a place of sheer boredom, what Levinas calls ‘the there is’, an impersonal emptiness which is ‘neither nothingness nor being’5 but may well be the state which Lyotard calls ‘post-modern’, a state of ‘incredulit y towards meta-narratives’6 in which there is nothing beyond the self which longs for immediate and intense experience. For Pikelet and Loonie, however, this longing leads to an encounter with the sacred, some mysterium tremendum et facinans at the heart of existence, as Rudolph Otto famously defined it. For the two boys this encounter begins not at the centre but at the edges of social experience, in ‘a rebellion against the monotony of taking breath’(p. 41), a gamble with death in which, diving into the local swimming hole, they stay underwater holding as long as possible and then surfacing to delight in the alarm they have provoked, the watching them, the tourists from the city especially. As time goes on, the boys’ contempt not only for ordinary folk but also for the town they live in as they come realise ‘how small and static and insignificant [it] really was’(p. 36), a prison from which escape is impossible, a form of fate, inhabited by the kind of people A D Hope described in his poem, ‘Australia’, Whose boast is not: ‘we live’ but ‘we survive, A type who will inhabit the dying earth.7 Loonie’s family has fallen apart: his mother has walked out on his father, the local publican, who consoled himself with other women. So he is more or less free to do as he likes. But for Pikelet finds it is more difficult to break out. Tom is always out to have a good time and doesn’t care who he hurts to do it. Huck always follows Tom’s lead even though sometimes he shouldn’t. Huck Finn grew up in a very rough environment. His father was a drunk who would disappear for months on random occasions. Huck is typically dirty and homeless. Eventually he goes to live with Widow Douglas who continually tries to reform Huck, but he resists and keeps his own ways. He said â€Å"The Widow Douglas she took me for her son, and allowed she would sivilize me; but it was rough living in the house all the time, considering how dismal regular and decent the widow was in all her ways; and so when I couldn’t stand it no longer I lit out. Tom is clearly the leader of the two because Huck is always following his lead. Huck says â€Å"Tom told me what his plan was, and I see in a minute it was worth fifteen of mine for style, and would make Jim just as free a man as mine would, and maybe get us all killed besides. So I was satisfied, and said we would waltz in on it.† (66) Also Huck says â€Å"Tom Sawyer wouldn’t back out so I won’t.† Another thing that is different is Tom is willing to keep a secret that hurts a lot of people. He knows Mrs. Watson has died, but keeps it a secret for his own enjoyment. He could have told and Jim would have been free, but all he cared about was his plan to escape and how fun it was going to be. You  can clearly see the differences between Huckleberry Finn and Tom Sawyer. There are many examples in the book that show that. Tom is the leader and Huck is the follower. How useful are sources A to C Essay In this essay I will assess the usefulness of sources A to C in determining the reasoning for American involvement in the Vietnamese war. Source A is reasonably useful in shoeing how the U. S government wanted the general public to view them and their reasoning for the countrys actions in Vietnam. Although source A does not state to whom the speaker (President Linden Johnson) is addressing this information. However, the mere fact that it is Johnson speaking, influences the reader to assume that it an audience of the general public that he is talking to. The time upon which he gave this speech is also very significant, as it was April 1965, one month after major bombing operation Rolling Thunder. This made the speech more significant as president Johnson was attempting to explain and justify the reasoning behind the major attacks that were taking place. In the first sentence of source A Johnson states, We fight in Vietnam because we have a promise to keep. He is about two different promises, the first being the Truman doctrine which states that America will give aid to any counties suffering from the threat of communism. This was set up to contain communism and prevent the domino theory, which was the theory that if one country were fall under the power of communism each neighbouring country would follow. Johnson again refers to the domino theory when he says The battle would be renewed one country and then another. The second promise that Johnson was referring to in his speech was an unwritten promise that he had to personally keep. And that was maintaining some of the traditional policies of previous American presidents, specifically over the war in Vietnam and the containment of communism. Also at the end of source A, Johnson quotes from the bible saying, Hitherto shalt thou come, but no further This was probably used because many American citizens were very religious at this period in time; therefore people to relate to it. Also the quote links the actions of America with Christianity, which would influence people into thinking what was taking place was right and true. Source B is also reasonably useful as it shows Johnsons real opinion on Americas involvement in Vietnam. From the first line the opinions are noticeably different from that which he expressed in source A. This is probably because source B is taken from a private conversation. The first line of source b brings his true feelings into the light as he says I dont think the of the country know much about Vietnam, and I think we care a hell of a lot less. This and other statements such as I dont think its worth fighting for. And I dont think we can get out, show that in may 1964 president Johnson was clearly against the war. Yet by the time of source A (approximately one year later) Johnson had ordered a mass surgical bombing of North Vietnam, named Operation Rolling Thunder. Therefore by this point Johnson had either drastically altered his views on the war or had succumbed to the pressure of knowing how horrifically tainted the images of himself and his party would become if he ordered a mass withdrawal from Vietnam. It is safe to assume that the latter is correct, as Johnson talks about this pressure in source B saying Theyd bring a president down if he ran out wouldnt they? This refers back to the reaction of the public and other politicians, which most likely be accusations of indecision towards his party (Democratic) on matters such as the involvement in Vietnam and the general Containment of communism. He would quite probably be labelled a traitor or a communist for backing out of the war and not sticking to the policies of the Truman Doctrine. Near the end of source B Johnson speaks of his fear of communism as he says Of course if you start running from the communists, they might chase you into your own kitchen. This is again referring to the Domino Theory that if one country falls to communism each in turn will follow. All of this shows the predicament that Johnson was in. That if he retreated he would be accused of backing communism, but if he chose to stay it would become Just the biggest God damn mess. Although the opinions change through sources A and B, source C is entirely different. It was written by Professor Noam Chomsky, a political critic and a leading anti-war figure during Americas involvement in Vietnam. The source was taken from an interview with Chomsky in 1982. Therefore he has the benefit of hindsight that aids him to analyse and criticise the attitudes and actions of the American government during the Vietnamese war. In source C Chomsky says Every book that comes out talks about how the United States was defending South Vietnam. And that this is now the Official truth. This is saying that although it is not a written law, but it is still widely considered that America was protecting South Vietnam from the Norths aggression. Chomsky disagrees with this saying The United States did attack South Vietnam. It destroyed the farming, the peasant society. This is commenting on the use of chemical weapons such as Agent Orange and Napalm, and tactical warfare such as Blanket and Surgical bombing. All these things contributed to the mass destruction of the South Vietnamese farms and forestation. This happened in Americas desperation to locate the rebel militia the Vietcong, and stop the use of guerrilla tactics against largely unaware U. S troops. However in attempting this the U. S forces damaged much of the Vietnamese agricultural lifestyle. And on occasion, American soldiers in frustration in their inability to locate the Vietcong would burn down whole villages at the nearest suspicion that they were helping the Vietcong. Later in source C Chomsky talks of how The U. S did not want and independent Vietnam He is saying that America did not want to allow Vietnam to decide their own future, and they did not want Vietnam to slip out of their strong Capitalist grip or orbit. To conclude, I believe that source A is the most useful in showing the reasons for U. S involvement. As it show all the pressures Johnson was under. The pressure to keep promises and the pressure to contain communism and prevent the domino theory, But most of all it shows the lie that he was forced to tell the public simply because it was what they wanted to hear.

Analysis of the Three Plans for Reconstruction The American Civil War, lasting from 1861-1865, was the most severe military conflict the country had seen; it involved the United States of America (the Union), and eleven secessionist Southern states (the Confederate States of America). The war was the upshot of decades worth of political, social, and economic conflict between the agricultural South, which produced mainly cash crops such as cotton, tobacco, and sugarcane, and the industrial North. The South depended on its four million slaves for its social and economic livelihood, whereas the North despised slavery as immoral and illegal. Even before General Lee’s surrender in 1865, the federal government was confronted with an acute dilemma, how to reunite the country. First Lincoln, then Johnson, and lastly Congress, imposed their ideas of how best to restore the Union, that is to say properly execute the task of Reconstruction. Reconstruction was initiated by incumbant President Abraham Lincoln before the war ended. On December 8, 1963, Lincoln revealed his rather extremely lenient Reconstruction plan. He proposed to grant a pardon to any confederate (excluding high-ranking officials), who would swear their allegence to the Union and accept the end of slavery. If ten percent of the 1860 voting population had taken the oath, that state would hold a constitutional convention. If the delegates had written a state constitution endorsing the 13th Amendment, that state could be re-admitted to the Union. Andrew Johnson, President Lincoln’s Vice President, and successor after his assasination in April of 1865, unveiled his own Reconstruction plan on May 29 of the same year. Johnson’s plan, which closely resembled Lincoln’s, said the President would appoint a governor to each state (after ten percent of the 1860 population took the oath Lincoln had prescribed in 1863), who would convene a constitutional convention. At this convention, the state had to write a new constitution, void secession, abolish slavery, ratify the 13th Amendment, and stop the payment of war debts. If given a pardon by the President, former Confederate officers and persons owning land worth over $20,000, could vote. Johnson felt that under his plan, Reconstruction would take a few months; in fact, the belief that his plan was too lenient towards the South –he granted 13,000 pardo... ...to restore Southern society to antebellum status (as demonstrated by his vetos of the Freedmen’s Bureau, and of the Civil Rights Bill); and as a result, replenish the ruined Southern economy. Congressional Reconstruction, brought on a complete social revolution in the south. The South had a military occupation on their hands, and due to their continual resistance to Reconstruction allowed for the passing of seven separate legislations, aimed at changing their way of life. Politically, blacks had significant potential with the right to vote, especially in Mississippi, South Carolina, and Louisiana, where they were the majority of the population. Blacks managed to gain seventeen seats in Congress (two were in the Senate), and an equivalent number of state offices. Had the South agreed to Lincoln’s terms, or even Johnson’s, they would have been able to continue politically, socially and economically just as they had before the war. Unfortunately for the South, their pride and ignorance, caused them to unknowingly choose the greater of three evils. Although Reconstruction ultimately failed, it would have attained optimal results had the South accepted Lincolnâ⠂¬â„¢s Reconstruction Plan.

Who’s Hungry? It’s almost 7:30 and the sun is just beginning to set for the night. I rush out of the shower and throw on whatever I have in my locker to wear. Dashing out of the locker room I try to avoid eye contact as I scurry out the door. If I stop to talk to a friend or check my mail I could miss my meal for the night. For at 7:30, the main dining facility and more than half the other on-campus will lock their doors until the next day. The inadequate dining hours at James Madison University have left students all over campus rushing out of various activities, classes and sports practices to try to get some much needed food and drink. Due to these extremely stringent dining hours, students are not performing as well and the university is missing out on a very profitable resource. Out of the thirteen dining facilities at James Madison University, only one is open past 8:00 PM throughout the entire week. This sole dining location is PC Dukes located on the ground floor of the Phillips Center (JMU Dining Services). Although it does provide quality food, the quantity you can get here for a punch is minuscule compared to Gibbons Dining Hall. A punch, as referred to by the students, is an equivalent of four dollars. At PC Dukes, this usually means a sandwich and a drink, while at Gibbons Dining Hall food is unlimited. Dining facilities, especially the main on-campus food facility, Gibbons Dining Hall, need to remain open later to accommodate everyone. By giving students more time to eat, more students would opt for the more costly meal plans and not have to load up on snacks and other items from off campus stores such as Wal-mart. The less students go off campus, the more likely their revenue is to stay in the university. The addition of dining hours would certainly benefit everyone involved in the university. Some dining locations are open past 8:00 PM several nights of the week on-campus. However, many of these eating facilities are relatively unknown to a large portion of the underclassmen. Most are located under dorms and hidden from the student’s eyes. They are also incapable of holding a large amount of students simply because they don’t have the room.

The Contributions of Frederick Douglas, William Apess, Sarah Margaret Fuller, and Sojourner Truth      Ã‚  Ã‚  Ã‚  Ã‚   As has been noted before, when we look at the authors of The Declaration of Independence, we are quite aware that the 'document' was written in the interest of the people who were there. The wealthy, white, landowners make up the Constitution to fit their needs and exclude everyone else. The people most notably left without rights are African American's, Native American's and Women. These minority groups formed a bond with each other because they were outside the dominant group. These groups of people helped gain their strength and voice through speeches and conventions with each one using the very words of the Constitution as their platform. During this time powerful voices spoke out like: Frederick Douglas, William Apess, Margaret Fuller, and Sojourner Truth, who didn't have the advantage of a formal education, but still found a way to become educated or taught themselves.    A brilliant speaker, "Abolionist, women's rights advocate,journalist and newspaper editor, social reformers and race leader, Frederick Douglas was unquestionably one of the most prominent black leaders of the nineteenth century and one of the most eloquent orators in American public life"(1751). Frederick Douglas was basically self-taught and his voice became so polished that he was in fear of losing the audience of his own race to the cause of freeing slaves because he sounded "too white". It is based on spiritual and Christian thought and that people are created and given their rights by God. Since most of these authors weren't taught in the classical sense the Bible was a useful and sometimes life altering tool. The main issues before the court in this case were as follows; -whether right to go abroad is a part of right to personal liberty nder Article 21 . Whether the Passport Act prescribes a ‘procedure’ as required by Article 21 before depriving a person from the right guaranteed under the said Article. -Whether section 10(3) (c) of the Passport Act is violative of Article 14, 19(1) (a) and 21 of the constitution. -Whether the impugned order of the regional passport officer is in contravention of the principles of natural Justice. The Supreme Court in this case reiterated the proposition that the fundamental rights under the constitution of India are not mutually exclusive but are interrelated. According to Justice K. lyer, ‘a fundamental right is not an island in itself. The expression â€Å"personal liberty’ in Article 21 was interpreted broadly to engulf a variety of rights within itself. The court further observed that the fundamental rights should be interpreted in such a manner so as to expand its reach and ambit rather than to concentrate its meaning and content by Judicial construction. Article 21 provides that no person shall be deprived of his life or personal liberty except in accordance with procedure established by law but that does not mean that a mere semblance of procedure rovided by law will satisfy the Article , the procedure should be Just , fair and reasonable. The principles of natural Justice are implicit in Article 21 and hence the statutory law must not condemn anyone unheard. A reasonable opportunity of defense or hearing should be given to the person before affecting him, and in the absence of which the law will be an arbitrary one. One of the significant interpretation in this case is the discovery of inter connections between Article 14, 19 and 21 . Thus a law which prescribes a procedure for depriving a person of â€Å"personal as o ul II t t tl the requirements otA 14 and 19 also. Moreover the ‘procedure established by law’ as required under Article 21 must satisfy the test of reasonableness in order to conform with Article 14. Justice Krishna lyer in this case observed that, â€Å"the spirit of man is at the root of Article 21†, â€Å"personal liberty makes for the worth of the human person† and â€Å"travel makes liberty worthwhile†. The court finally held that the right to travel and go outside the country is included in the right to personal liberty guaranteed under Article 21 . Section 10(3) (c) of the Passport Act is not violative of Article 21 as it is implied in the provision that the principles of natural justice would be applicable in the exercise of the power of impounding a passport . The defect of the order was removed and the order was passed in accordance with procedure established by law. The hon’ble Supreme Court in this case laid down a number of other propositions which made the right to life’ or ‘personal liberty more meaningful. Maneka Gandhi case has a great significance in the development of Constitutional law of India.

Portarait Painting

Portrait painting. Horatio once said: A picture is a poem without words . Really, a painting can speak loudly  than thousand words. A painting is the most effective exhibition of one’s  idea about a particular concept or material. A great painting enriches our experience of life, just as a great poem does, since great painters make us see and think a great deal more than the objects before us, they teach us to look at a scene through their eyes, their imagination. It  can explain a story which will take several pages if it is explained in  words. Today I’d like to draw your attention to portrait painting.At first, I’m to present the definition of this genre of painting, than I’m to speak on three artists William Hogarth, Mary Cassat and Valentin Serov as the representatives of three different movements in portrait painting. As Britannica says Portrait painting  is a  genre  of  painting, where the intent is to depict the visual appearance o f the subject. Beside human beings, animals, pets and even inanimate objects can be chosen as the subject for a portrait. Portraitists create their work by commission, or are inspired by admiration or affection for the subject.Historically, portrait paintings have primarily memorialized the rich and powerful. Today, the portrait painting is still commissioned by governments, corporations, groups, clubs, and individuals. As you can know there are a lot of movements in painting in general and in portrait painting in particular. They range from realism to pop-art, but I’m to single out realism, impressionism and modernism. The movement of realism is based on the exact reflection of human face and body. Clear and exact lines, realistic colours are typical of it. The representative of this movement is William Hogarth.He is considered even one of the founders of realistic movement in Britain. Hogarth emerged as an important  portraitist, producing several impressive small-scale i nformal group portraits of members of a family or friends and a number of sensitive portraits of individual sitters. The example of realistic style is expressed in the painting The Shrimp Girl. It was painted around 1740–45. The painting, a relatively late work by Hogarth, is one of several in which he experimented with a loose, almost  impressionistic style, nevertheless even in this portrait the painter tried to find the beauty in real life and its reflection.The painting depicts a woman selling shellfish on the streets of London, typically a job for the wives and daughters of fishmongers. One of the brightest movements of portrait painting is impressionism, characterized by loose and broad strokes, diffused lines and even the distortion of human body. The wonderful representative is Mary Cassatt. She was a wonderful American painter and her place in the history of American art is unique, because she responded in a very distinctive way to the mandate to portray modern lif e.Cassatt created a personal language out of the grammar of Impressionism. Most often, she portrayed women like herself, e. g. Miss Mary Ellison is the second of two portraits of Mary Ellison, which was created in 1880. Cassatt there concentrates on Miss Ellison's contemplative mood. In this painting, Cassatt’s brushwork is open and sketchy, colours are soft and even merge. The mirror behind Ellison is a device the artist used often; its presence allows the expansion of the composition's implied space to include areas that the viewer could not otherwise see.The last movement I’d like to mention is modernism. It appeared on the basis of impressionism, and even if strokes are broad and strong, lines are clear and human face and body are reflected almost exactly. In general, modernists embellish () the image. Valentin Serov is a famous representative if the movement. In fact, in his style of painting there was his classical technique when one precise stroke of brush was a pplied without further reworking. Serov is seen as the first Russian modernist, and his composition Girl with Peaches(1887) initiated the style of Russia.In the painting Serov pieces together fragments of the interior scene and still-life. The light pours in through the window and dissolves the contours of the objects. Serov uses warm tones for the girl which in some way contrasts with the colder tones of the space. The girl is painted almost exactly in clear lines and good proportions. To conclude the topic I’d like to say that different movements in portrait painting are the result of painters’ views on art, painting. Their style always reflects their epoch and predominant movements in other spheres. But paintings in any genre excite and impress.

Role and Functions of Law Paper Amber Freetage Law/421 November 19, 2012 Eric Nord No matter where we are in our country, we are surrounded by many of them, and guarded by few. Some are short; some are long but no matter what they control every potential move we make day in and day out. We are talking about laws. By definition laws are, â€Å"a rule or set of rules, enforceable by the courts, regulating the government of a state, the relationship between the organs of government and the subjects of the state, and the relationship or conduct of subjects towards each other,† (Law.N. d. ). Over the years, our laws have changed and been added to in order to protect not only us as individuals but our businesses as well. Even though there have been limits placed by the U. S. Supreme Court, our Congress still exercises very broad powers to pass laws where the activity being regulated affects interstate commerce in any way (Chapter Two. P. 32). they have the authority to maintain chan nels of interstate commerce, the instrumentalities of interstate commerce, and the articles moving in interstate commerce.For our business’ this means that the Congress gets to have control or at least the final say with any involvement with vehicles used in shipping, our railways, and our beloved highways. Meaning any business transactions that are from state to state or across country the Congress can step in and change things to accommodate the law. For our business’ that rely on tourists, which many of our ocean front city’s do, it means that the cost for being open, staying open, and selling prices of items may be affected.This is true because Congress has the power to tax the citizenry and to spend the federal government’s money in any way that they see fit, as long as it generates common defense and general welfare. Another use of commerce power is within the Civil Rights Legislation. This commerce power is one that has affected our businesses, sch ools, and everyday lives because it gave Congress the power to ban any form of discrimination in places of public use (hotels, restaurants, stores).Placing this ban against discrimination allowed everyone the chance to shop, stay, work, and eat wherever they chose because those businesses made purchases or held business activity out of state. â€Å"States often wish to regulate commerce that crosses into their state borders. States are free to regulate commerce so long as (1) it does not impose a discriminatory law (such as a tax) on out-of-state businesses, and (2) the state law is a legitimate effort to regulate health, safety, and welfare,† (Chapter Two. P. 35)While we cannot go into deep detail of every law that regulates and mandates us to maintain a strict lifestyle or to keep a legit business’s doors open it is very important that laws are taken seriously so that lawsuits are prevented and as individuals, we are not put behind bars. While laws can be hard to und erstand, the ones that pertain to us as people are known or learned from experience or from our teachings. As a business owner take the time to know what guidelines we must follow in order to keep our job.In a previous employment position, knowing the laws came to be very informative. Federal laws are set to every state and no one can change them, except for the President, or Congress if all in agreement or high votes, but get to know the state laws where you reside. In a previous occupation, learning the laws became much easier when pointed in the right direction. As a full time employee, working no less than eight hours a day it became very apparent that I should be entitled to a break of some sort, but was not given one.After a few other employees started to mention this as well, we began to look into what we were supposed to be given as a break. To our surprise in an eight-hour day we should be given no less than a thirty minute break for lunch and two ten minute breaks to use t hroughout the day, according to the State work laws. However, when we looked through our employee handbook, breaks are not mentioned at all. When we asked management about the issue we were told, â€Å"Your breaks are in between customers. A little extreme but okay so we kept asking and we found out that since North Carolina is a right to work state there is nothing we can do but work as we are scheduled without breaks or be in fear of losing our job all together. So, you see laws are very important to learn and keep up with because you can be getting taken advantage of without even knowing what you are entitled. Running head: SPORT VIOLENCE Essay

Violence is defined as â€Å"the use of excessive physical force, which causes or has obvious potential to cause harm or destruction.†(Mchill) Sport violence an issue or just part of the game? Where is the line drawn among players, fans, and media? With violence being so prominent in sports today the love of the game is being over shadowed by the need to win. Coaches, parents and players are being instructed to win at all cost, these tactics are then being glorified by the media and supported by the fans as good entertainment. The top three issues involving sport violence is media portrayal, fan identity, and youth sport violence. Media portrayal of sports violence is shown and read on every type of media outlet. Are the constant replays shown on ESPN of a player getting rocked in a game really necessary? Or how about the top ten worst hits? What type of message is this sending to young athletes? Media outlets are glamorizing athletes that are usually the aggressive and violent ones on a daily basis. Yes, athletes are being penalized for these violent actions but being replayed on ESPN 15 times a day really sending a message that violence is a part of the sport and promoting violence to solve problems? On the other side of the argument, exposure to sports violence by the media has stimulated efforts to control and prevent behavior by multiple fines and penalties. Also a high school athlete being scouted for a college sport can utilize the media to showcase the player and give an advantage to be recruited to the team. Spectator violence is present in every level of sport. From youth sport to professional sport, spectators lose control of their emotions and commit acts of violence against players, coaches, officials, and other fans. There are several factors that lead spectators to commit acts of violence: strong team identification, strong team loyalty, alcohol, and situational variables such as a team loss or fans of opposing teams sitting in close proximity and instigating each other. While the passion that spectators have for their team is a positive characteristic and it drives the success of the sport industry, the negative cost is that the passion can turn into criminal and deviant behavior which takes away from the enjoyment of the game and puts others at risk; endangering their right to enjoy watching a contest by having their safety jeopardized. However, all is not lost. There are policies and procedures that can be put in place to help curb spectator violence, but it takes a commitment from the top leaders of each individual sport organization to take a stand against such destructive behavior. Youth sport violence is a growing concern for all involved. A large part of child development comes from the involvement in youth sport. The problem is what they are being taught from overzealous coaches and parents who push for the win at all cost. The youth are learning to use unnecessary roughness and poor sportsmanship with little repercussions. The parents and coaches are the largest issue because they providing poor examples for the children. The ethical issue becomes whether it is ethical to included additional rules to youth leagues. The solution developed is for stricter rules or more serious repercussions for coaches, parents, and players. These rules are in hopes that they will bring youth sports back to a positive atmosphere it was once created for, without parents and coaches influencing youth poorly. Introduction Sport Violence in the 21st Century has become a major ethical issue. From the youth level to professional sports, fans, players, coaches, and media are guilty of contributing to this problem. Sport Violence is changing the way in which games are played, observed, and coached. Issues surrounding Sport Violence are not limited to the playing field but are spread throughout society. The major areas in which sport violence impact society are within the actual sport participants such as players and coaches; the media, and the spectators. One of the major issues is that sport violence is impacting the youth of America. The youth struggle to distinguish what they see on tv and what they are allowed to do themselves. They see violence and think that that kind of behavior is appropriate so they behave similarly during their games and may coaches do anything to stop it. In fact, many coaches encourage violence and poor behavior with a Win At All Cost mentality. Some people hold sport media accountable for the growing issue of sport violence because the media tends to glamorize and glorify violence in sports. When there is a violent hit or a fight in a game, the media will continually show the incident from several angles. While the announcers might be discouraging the poor behavior, the production continues to show it again and again instead of cutting to commentary or a commercial. Another example of how media spreads sport violence is the Top 10 lists of biggest hits, hardest knock outs, or most bruising pitches. The problem is that violence sells and the producers know it; which leads to another issue in sport violence: the spectators. Spectators love watching the violent hits and the hardest knockouts over and over. Just as a bad car wreck makes everyone stop and look, violence in sports catches people’s attention and invokes an emotional response. Therefore, the spectator’s response to the media is cyclical and they both drive each other. Additional concerns of spectators and sport violence is the emotional ties that individual’s feel to their team. This type of team identification can influence an individual to commit their own acts of violence if their team loses or if they feel threatened by a fan of another team. Spectator violence lives in youth sports, high school sports, collegiate sports, and professional sports. It’s negative influence is overreaching and permeating. Analysis and Discussion: Are parents and coaches encouraging kids to use excessive force in sports in order to win games? Where is the line between a good play and unnecessary roughness? Violence in sports is a topic of many sport enthusiasts and is an even large concern when it involves youth sports. The issue is discovering what is causing sport violence in the youth. There are a many outlets that help influence excessive force, media coverage of professional sports, parents and coaches with a win at all cost mentally. Is violence in youth sport a result of sport being to competitive? Youth sports were started to help develop children’s identity, physical skills, social skills, teamwork, and brain function. All the positive effects are true for youth sports if the focus is on developing children and not as much on the score of the game. While there is a place for competitive nature in youth sports it should not cause unnecessary roughness by the athletes. Arthur-Banning cited scholars saying â€Å"youth sport can be used to promote lifelong physical activity and enjoyment of sport, but only if programs are specifically designed with this intent.†(Smith & Smoll, 1997; Weiss & Petlichkoff, 1989)(p.4). A large problem lies in adults who cannot put aside their desire to win and therefore get out-of-control. This includes yelling at the umpires, fighting with other parents, yelling at players, etc. When children observe this behavior they believe it is acceptable to do the same. This behavior then fosters more poor behavior for example, blaming others for their actions and not taking responsibility. â€Å"The competitiveness permeating youth sports today often leads to exploding tempers, vile verbal assaults and sometimes fisticuffs, placing the child in the middle of the melee. Finding the balance between the positive and negative lessons that aggression teaches is the key, according to Tofler.†(Focus on Family, p. 4). It is parents and coaches job to groom well tempered athletes during their youth. In a study by Kerr explains four types of violence in sports which are important to be able to identify the difference between the in orders to determine the use of the violence. There is â€Å"play violence† which is just playful but is a concern when it escalates to â€Å"anger violence† which is serious anger that is unpleasant. The third is â€Å"Power violence with a serious purpose and tends to take the form of cold, calculated violence† this is an excepted form of violence in sports like boxing and karate but not football. In sports like football i t would be unnecessary roughness. The fourth type to be aware of is â€Å"thrill violence is usually provocative and spontaneous, providing pleasant high levels of felt arousal and felt negativism† (Kerr, 2009, p.45). If coaches and parents are aware of the type of violence the athlete is displaying they can take correct measures to prevent it from happening again. By having the adults support positive sportsmanship and punish or discourage poor sportsmanship it will teach the young athletes how to respond to different situations. The adults should focus on how to help their children control emotions during a game which will help the kids develop skills that can be used outside of sports, like conflict resolution. Ian Tofler, M.D. â€Å"says, for the most part, sports reflect society today. He asserts that the American way of life embraces assertiveness, aggression, but also resiliency. Learning such attributes from sports is essential in teaching moral and ethical development.†(Focus on the Family, p. 4) Sport can be a positive part of children’s youth if done correctly. Youth sport administrators should ensure there are guides to support positive experiences for children in sports. To fix violence in youth sports additional rules may need to be in place for coaches and parents. Would it be ethical to put rules in place to give parents or coaches technical fouls based on their negative out bursts? Would it be ethical to eliminate athletes from a league for excessive use of roughness? Is it ethical to continue to allow youth violence in sport to occur with little repercussions? The issue in question is whether it is ethical to make additional rules for youth sports to help prevent youth sport violence. These rules would be directed to parents, coaches, and athletes holding them more responsible for their actions. Cavanagh decision-making model will be used to decide the most ethical option. Using the Utilitarian theory is the first step of the model. â€Å"The greatest good for the greatest number† (Cavanagh, p. 141). Facts that support more rules are; helps kids develop problem solving skills, develop sportsmanship, children staying safe, children will understand right from wrong, parents and coaches will be punished for acting out, and the youth games will be focus on learning instead of just winning. The facts that go against more rules are; games are less competitive, could embarrass parents, coaches and parent do not give feedback positive or negative, and athlete fool around in the game. Overall the greatest good for the greatest number of people would be to instill additional rules. With additional rules it will teach children important life skills they can take with them in the future. For the parents and coaches they will begin to understand the game is for the kids to have fun and learn. Sports violence will go down because if things escalate out of control the parents, coaches, or athlete could be thrown out of the game or league. They all will understand that poor actions lead to repercussions and youth sports will be what it was designed for, education and fun. The second step to the theory is Rights, â€Å"They enable individuals to pursue their own interests and they impose correlative prohibitions and/or requirements on others.†(Cavanagh, p. 142).The rights that are for additional rules for youth sports are; life and safety, truthfulness, freedom of conscience, right of autonomy and Privacy? The players, coaches, and parents have the right not to have their life or safety endangered at a youth sport event because of violence. Truthfulness supports the rules because other players and coaches have the right to know the intentions behind a play. If the player was told to win the game at all cost the opposing team has the right to know the intention of foul play. Freedom of conscience supports the rules because if parents, coaches, or player’s choice not to adhere to the rules they will be asked to leave because they are violating the moral rules put in place. The right of autonomy side favors the rules because if the parents, coaches, or players do not like the added rules they can choice not to participate in the league. On the other hand the right of free speech, privacy, and autonomy go against the additional rules. Parents and coach have the right to criticize conscientiously as long as it does not violate others, giving them the right to yell at players, coaches and officials at a game. Parents and coaches have the right of privacy to conduct their parenting or coaching style however they see fit. In conclusion the right that weighs the heaviest on this issue is the right to life and safety. The additional rules will keep parents, coaches, officials, and most important children safe during games. The most important thing in youth sports is education and fun, which mean unnecessary roughness or the winning at any means necessary does not have a place in youth sports. The third ethical criteria for determining if additional rules should be put in place for youth sports, in order to limit youth sport violence is justice. â€Å"Justice requires all persons, and thus managers too, to be guided by fairness, equity, and impartiality.†(Cavanagh, p.144). The parts of justice that support the additional rules are fair administration, fair compensation, and fair treatment. The administration will uphold the â€Å"rules consistently, fairly and impartially.†(Cavanagh, p.143). Fair compensation supports the new rules because it holds individuals involved in the act of violence responsible for the injuries they have caused on the other individuals. Each parent, coach, and player deserve to be treated the same unless they decide to act in an out of control fashion. The cons against the new rule are fair blame and due process. Parents or coaches should not be â€Å"held responsible for matters over which they have no control†(Cavanagh, p.143). Parents or coaches might not necessary be responsible for the actions of their children during the game. Parents or coaches can make the argument that their rights are being violated by adding additional rules to youth leagues. Again the justice criterion leads to the addition of rules to youth leagues based on fair treatment. If an individual chooses to act out they are setting themselves apart from others and therefore, should be treated in such a way by given them repercussion for their negative actions. A fair solution to this ethical issue of violence in youth sports is to add additional rules to youth leagues. The leagues can start by having all players, parents, and coaches sign an agreement to conduct themselves in a fair and proper manor. In addition they will be made aware of penalties or repercussions if they do coach their kids to use unnecessary roughness or if they have out of control burst which will be determined by the officials. The penalty they receive will be based on remarks or actions taking by the individual. The officials will have the right to give out these penalties based on new league rules. The rules will make examples out of offenders to encourage others not to violate the rules. Lastly, before coaches are allow to coach a team they must attend a seminar or clinic that explains what is demeaned unnecessary roughness, out bursts, and other unfavorable actions. All parents will be invited to clinics and seminars but are not requiring attending unless one of the rules is violated. If one of the rules are violated it is mandatory for the people involved to attend with their child to the clinics or seminar. Violence in the media has been is a topic of great concern for many of years to parents, educators and even medial professions. There doesn’t seem to be many positive aspects to violent television shows or sporting events. There will always be the debate over why some people react with violence after watching violent media being played over and over on sports stations and some do not, but the fact remains that there are only a few good reasons to see so much violence in such detail. Mass media can be said to have a large contribution to the acceptability of sports and violence. The media plays a vital role in sports and how it’s portrayed. Through the media exposure, many people to sports-related violence are tuned into the television, magazines, newspapers, and radio, thus providing numerous examples to children and young adults who may imitate such behavior. Violence through the media can glamorizes players, often the most controversial and aggressive ones. On the other hand, the exposure given to sports violence by the media has stimulated increased efforts to control and prevent such behavior by multiple fines being set in place and many penalties. One of the most recent events that involved violence in sports and media exposure is the Detroit Pistons vs. Indiana Pacers brawl. A little recap of the incident was Pacers forward Ron Artest stretched himself out on the scorer’s table, where he was hit by a cup of beer thrown by a Detroit fan. Artest, followed by a number of other Pacers, charged into the crowd, throwing punches. The fight lasted about 10 minutes. Officials eventually called the game, and the Pacers were showered with beer, popcorn and debris as they left the court; a chair was thrown during the brawl and a number of people were treated for minor injuries. Not only was this fight showed on ESPN for weeks, it was shown on national news stations across the country and analyzed every aspect of it. The YouTube video of the fight received millions of hits and today is still showed as one of sport’s most violent brawls. In 1961-1973 a study was done by Ontario Royal Commission on Violence. On average 15 hours of â€Å"very aggressive† and â€Å"aggressive sports† were televised per week, and in 1973 the average raised to 21 hours per week. The most obvious and over played argument would be the negative result of violence in the media and how it promotes violence to solve problems. By watching detailed violence, it sends a message that violence is acceptable way to play sports or be â€Å"competitive†. Some examples of how the media relays violence in sports could be by the constant replays of massive hits, slow motion showing every impact including the player’s distressed face, and even zooming in on the player that was injured. Shouldn’t media outlets be portraying sports as skilled and professionalism? Instead televisions are full of â€Å" top ten painful plays† or â€Å" top ten hits† or â€Å" best fights of 2012†. What message is this sending to athletes of every age? Smith (1978) did a study on how much violent material do young athletes consume through media. The results were about 65% of youth athletes attend pro hockey games 2-3 times a year, 53% said they read about pro hockey on a daily basis and 80% watch it weekly. Consumption went up with age. Hockey can be thought to be one of the most violent sports next too football with the legal fist fights. Smith (1983) asked â€Å"Have you ever learned how to hit another player illegally from watching pro sports?† and 56% of the 604 participants said yes. With a little over half of the people watching sports learned how to illegally hit another player during a game is intense. This could possibly mean the outlet of television or media is the reason why violence in sports in on a rise. It was reported by Sports Business Journal that in 1987-1988 the NBA had more fist fights than Professional Boxer Mike Tyson. Finding many pro sides for violence in sports through the media was a little more challenging. Receiving a college scholarship is almost impossible these days. Without the help of the media portraying them as the best of the best it would be a lot harder for schools across the country to recognize or even notice potential athletes. A defensive player in football gets his position by being aggressive and making important tackles, even if it’s a violent play. Recording these plays or writing about them gives an advantage to the athlete trying to get into college. Also, media coverage can greatly enhance the chances of violent offenders being caught. There have been several examples of players, who were not reported by officials during a match, being cited by sporting bodies, clubs or tribunals after the event. Media footage has also helped track down perpetrators of violent acts off the field. Known by many, some sports are violent by nature. Boxing is the obvious example, where physical attack is the point of the exercise. There has been much debate over the sport and the media coverage for such violence this form of â€Å"violence† is within the rules of the sport and the possibility of injury is well known by participants and by viewers so by showing coverage of these types of sports are accepted and are not merely portraying violence as acceptable outside of the sport. The question related to media and violence is whether showing violence in sports through the media outlets ethical? Cavanaugh decision-making model will be used to decide the most ethical options. Utilitarian theory is â€Å"The greatest good for the greatest number† (Cavanagh, p. 141). Actions are evaluated by judging their consequences and weighing the good effects and bad effects and the attempt is to achieve an optimal balance of benefits versus harms on those affected by the action. Facts that support media coverage of violence is that viewers like to watch action in sports, violence is a part of the game, intensifies the game and may help high school athletes get noticed for college. The facts that go against media coverage of violence are; too graphic, no need to show people getting hurt, violence and competition are two different things violence only degrades the sport or player. Overall the greatest good for the greatest number of people would be to allow the media to cover violence in sports. Now days people watch sports through the television or watch highlights through media such as ESPN. Some people only want to see the important plays of the game. Let’s face it, the more intense sports are the more people will watch them, even if it’s a nasty hit, or brawl in a basketball game. Rights theory is the next step. The rights for media coverage of sports violence are; truthfulness and right of free speech. Truthfulness supports this theory because the media have the right to be truthful in what they show and not alter the media or certain outbreaks. Censorship is allowed but if a major fight breaks out is it ethical or unethical to show it? Do the people have a right to see what happened? Under the right of free speech commentators and sports broadcasting channels have the right to criticize others as long as it doesn’t violate the rights of others. If it happened in the game why wouldn’t the media be allowed to play it and talk about it? The last theory is justice. The theory of justice requires decision makers to be guided by equity, fairness, and impartiality (Cavanagh et al., 1981). It relies on three types of moral prescriptions: (1) that individuals who are similar in a relevant respect should be treated similarly and individuals who are different in a relevant respect should be treated differently in proportion to the difference between them; (2) that rules should be administrated fairly and clearly; and (3) that individuals should not be held responsible for matters over which they have no control, and should be compensated for the cost of their injuries by those responsible for these injuries (Cavanaugh et al., 1981). Decision making and reasoning based on the theory of justice focus on the distributional effect of actions (Cavanagh et al., 1981). Under these criteria’s I believe it is ethical to show violence in sports throughout media. Though violence throught the miedia will never go away some of the alternatives I came up with were to limit the number of times a aggressive play is shown on TV and have a warning for younger kids that what is about to be shown is graphic so parents can decide whether its appropriate to show the violent acts. Over the past several decades, sport violence has become an ever-increasing topic in North America. The topic of violence usually revolves around athletes, teams, and the organizations themselves. For instance, Ron Artest, also ridiculously known as Meta World Peace thanks to his name change, is more widely known for his violence than he is for his basketball skills; most recently for his violent swing of the elbow to the head of James Hardin during the last week of the 2012 NBA regular season. The New Orleans Saints’ publicity has shifted over the past year from the America-loved Hurricane Katrina World Champions to the America-despised Bounty Hunter team who offered inside bonuses to those defenders that had the biggest and most damaging hits to the opposing team. And finally, just about since its inception, the entire Oakland Raider football organization has been labeled as poor sports, violent, and unethical due to the organizations predisposition for everything that goes against ethical behavior. Traditionally, much of the attention has focused on the ones in the big spotlight, and only a small amount of attention has focused on the ones in the background, the ones who passionately follow and support the athletes, teams, and organizations: the spectators. No doubt, spectators make the sport world go round. With the Sport Business Journal’s estimate of $194.64 billion spent in the year 2001, if it wasn’t for the spectators, the sport industry would not be as successful (Chelladurai, 2009, p. 10). The shear economic impact of sport within our society is extremely important in driving the American economy, and with the thrilling permeation of sport within American society, spectators have the ability to make or break the sport. American’s love their teams. The passion and excitement that the success of teams creates within the spectator is unparalleled to anything else. The biggest sport stadiums in our country, The Big House at the University of Michigan for example, bring out over 100,000 spectators for each event. Nothing else in our society encourages this kind of commitment and participation over an extended period of time. The biggest concerts can bring close to that many people, but the concert only lasts for one day in one location and then the show moves onto a different city or state. Certain protests, parades, or political events can draw crowds over 100,000 but once again, the actual event is usually only one or two days and the difference between these events and sports/concerts is that these events do not cost anything to attend. For spectators to commit their support over entire seasons, year in and year out, requires an ongoing investment in mental, emotional, financial, and cognitive resources. This kind of relationship between spectator and team is remarkable. Few events in our society can compete with the extreme emotional highs that sports can invoke within ones soul. However, with the emotional highs come emotional lows. For the majority of time, sports have a very positive impact on society, but at other times sport has the ability to influence spectators to commit unlawful and undesirable acts of violence and aggression. It is during these times when sport has a negative role in our society. To begin the discussion about spectators it is important to have a fundamental definition. Nicholson and Hoye (2005) define spectators as â€Å"supporters and parents†¦Ã¢â‚¬Ëœbench’ players, coaches, team, club or league officials, venue staff and general public within the view of the field of play† (p. 95). All of these individuals play an important role when it comes to making sport a positive experience or a negative experience. The role that media, players, and coaches play in sport violence has already been discussed. The remains of this discussion will be focused on the individuals outside those two areas; specifically the spectators known as the fans. There is the obvious physical violence that spectators can invoke on each other, the officials, the players, and the coaches. For the purpose of this discussion, poor behavior not resulting in physical violence is going to be included with the overarching topic of â€Å"violence.† Nicholson and Hoye (2005) define poor behavior as â€Å"Foul language, abuse of officials, racial and ethnic abuse, sexual harassment, throwing missiles, drunkenness, pitch invasion, and acts of violence† (p. 98). These undesirable acts can be directed towards fellow spectators, players, coaches, and unfortunately officials. In fact, Nicholson and Hoye (2005, p. 100) found that the perception of performance of game officials was one of the key catalysts for poor behavior. Apparently, when things aren’t going the way of their desired team, spectators look to release their frustrations on something or someone and contest officials are the easiest target. Further, spectator violence is not limited to the times between the first and last whistles. Spectator violence takes place before games, during games, and after games and the violence can take place just about anywhere. It can take place at sports bars and pubs that aren’t located anywhere near the venue, or it can happen on the streets that surround the venue either before the game or after the game. Spectator violence can break out in the parking lots of the venue during pre-game tailgate parties or post-game events and it can also happen at the venue entrance/exit points, in the mausoleum, in the stands or even spread to the playing surface. With such a propensity for spectators to commit acts of violence and criminal behavior, venue and event managers are concerned with how to stop it or at the very least control and minimize it. However, understanding the cause should come before finding the solution. First off, let’s not confuse passion with violence. One of the greatest draws of sport competition in our society is the camaraderie created between players, teams, organizations, and fans. The passion and excitement created by this bond is what keeps people coming back day in day out, week in week out, and season after season. This bond is known as team identification and studies have shown it’s one of the strongest predictors of spectator violence. It’s easy to point out the obvious individuals that are high in team identification. For example, Barrel Man is a historic figure in the history of the Denver Broncos and the Mile High Stadium. Certain high schools have spirit squads that are front and center at every game and they have specific names like â€Å"Kadet Krazies† for the Air Academy High School Kadets and the â€Å"Rowdy Rams† for the Rampart High School Rams; both in Colorado Springs, CO. However, team identification is not always as visibly obvious as the aforementioned examples. Many fans feel a strong sense of internal and emotional relationship with their team. Either way, team identification is a strong variable in determining spectator violence. Wann, Carlson, and Schrader (1999) classified spectator aggression into two categories: hostile or instrumental. Hostile spectator violence involves violent actions that are motivated by anger with the goal of harming another person. Instrumental spectator violence refers to actions intended to harm another person with the goal of achieving a result other than the victim’s suffering (p. 279). This kind of violence is highest amongst individuals high in team identification and that experience a situation that is unfavorable to their personal desires; such as a team loss. These two elements can combine to make an explosive situation at sporting contests. Consider additional variables such as alcohol, age of spectators, level of game importance (playoff game), and nature of the sport (football as opposed to volleyball) and the potential for spectator violence only increases. No matter why or how spectator violence happens, the ones involved are almost always perceived as hooligans, hoodlums, or deviants and whenever violence does break out it always puts a blemish on the image of the particular sport or team. As mentioned in the beginning of this section, individuals or organizations involved in violence are seen as unethical and looked upon negatively in our society. Spectators are just as vulnerable to the negative perceptions and are also seen as unethical individuals that detract from the spirit of the game. In effort to determine the level that spectator violence is unethical, this issue should be processed through the Cavanagh Model of Ethical Decision Making. Three criteria are considered when making this determination: Utility, Rights, and Justice. The fundamental principle of utility is that whatever makes the greatest good for the greatest number of people is the ethical decision, act, or policy. If spectator violence were to occur at every sporting event across the globe than one could say that it negatively impacts the majority of people and it is therefore unethical. However, when comparing the total number of sport games that take place in the world to the total number of times that spectator violence occurs, the number of incidents of spectator violence is relatively small. Therefore, based on the utility criterion, spectator violence is considered to be ethical. The notion of rights is the next criterion to consider in making the determination of spectator violence being ethical or unethical. Spectators have a right to enjoy a sporting contest without their life or safety being threatened. On the same topic, Nicholson and Hoye (2005) explained the notion of spectator violence breaking individual rights as this: â€Å"Poor spectator behavior can impinge on the ability of people involved in sport to enjoy a safe physical, social, and cultural sport environment† (p. 95). In making a determination of spectator violence being ethical or unethical based on the rights criterion, one must conclude that spectator violence is unethical due to the fact that it violates individual’s rights to enjoy a sporting contest without their lives and safety being threatened. The final criterion to consider in determining spectator violence being ethical or unethical is justice. â€Å"Justice requires all persons, and thus managers too, to be guided by fairness, equity, and impartiality. Justice calls for evenhanded treatment of groups and individuals (1) in the distribution of the benefits and burdens of society, (2) in the administration of laws and regulations, and (3) in the imposition of sanctions and means of compensation for wrongs a person has suffered† (Cavanagh, 1984. p. 144). There are several justices to consider in this case: fair administration of rules, fair compensation, and due process. In regards to fair administration of rules, everyone spectator is held to the same high standard of appropriate behavior. No spectator gets a special rule allowing them to act inappropriately. Therefore, fair administration of rules cannot be counted as injustice when looking at spectator violence. Now, in the event that spectator violence occurs, there are often innocent bystanders affected by the violence. Sometimes they are just emotionally scarred or threatened and other times they are physically harmed. In the case of physical harm incurred by innocent bystanders, these individuals expect that they receive fair compensation for their injuries and that the violent aggressors be held accountable for their actions. However, in the case that the perpetrator is not held responsible for their act of violence and the victim does not receive fair compensation for their injuries, justice is not being served. It can be assumed that the majority of time that a violent mob breaks out and an innocent bystander gets injured, that the individual responsible for that injury will not be detained or held responsible. Only in the time there was physical evidence convicting the violent spectator will the victim receive fair compensation. More often than not, injured bystanders are taken to the emergency room for treatment of their injuries and the perpetrator is not held responsible. This situation blends into the idea of due process, where an individual has a right to a fair and impartial hearing when he or she believes that personal rights are being violated. As explained previously, spectator violence impinges on individual’s rights to enjoy a sporting event in a safe environment without their life or safety being threatened. In the case that this right is violated and someone’s life or safety has been threatened to the point of injury or harm but they are not able to bring suit on an individual or organization due to the nature of the event that occurred, then there is a strict violation of due process. To answer the question of spectator violence being unethical or unethical based on the criterion of justice, the conclusion is that spectator violence is unethical. Spectator Violence is determined to be unethical yet unstoppable, but what policies or procedures can organizations put in place that help control or minimize the violent behavior? Nicholson and Hoye (2005) discuss strategies used to manage poor behavior and their identified strategies fall under 3 categories: Preventative, which are strategies designed to educate spectators and develop a better culture; Immediate, which are strategies to deal with poor spectator behavior as they occur; and Post-Incident, which are strategies designed to punish or prosecute poor behavior after an incident (102). Preventative strategies include providing safe and secure entrance/exit points for players, coaches, officials, and spectators; providing and displaying code of conduct packets for spectators; additional education for officials on how to best handle volatile situations; strategically place bars or â€Å"wet† areas to minimize alcohol induced violence; limit alcohol consumption; development and implementation of national rules and expectations; and provide a more than sufficient number of event staff and security. Immediate strategies include removing the spectator/s from the event, cancelling the event, and the use of a Yellow/Red card system where a yellow card is a warning and a red card is a removal from the event. Post-incident measures include removing players that have a tendency to invoke violence amongst spectators, suspending players, and banning the entrance of spectators who are consistently detrimental to the game experience. There is not a one size fits all solution to curbing spectator violence. For instance, the Denver Broncos are not able to keep an individual from returning to future games. They may be able to prevent that individual from purchasing a ticket but that’s easy to circumvent if that spectator has a friend buy tickets for them. The individuals working the ticket gate are not equipped to check every person’s id so they cannot prevent the perpetrator from entering the venue unless they have specific knowledge that the perpetrator is trying to enter at a specific gate. Instead, venue and organization management should put as many of these strategies in place in order to minimize spectator violence and provide a positive safe environment for all to enjoy. Conclusion: The major points in this analysis report are the ethical dilemmas with violence in youth sports, violence through the media and spectator violence. Ways to help maintain and prevent violence in youth sports are making sure the there are signed agreement for players, coaches, parents, administering additional penalties or repercussions for unnecessary roughness or out of control and finally running clinics and seminars on the preventative measures on violence in the specific sport being played. Violence through the media can be monitored by limiting the number of replays of a violent hit or fights and seeing out warnings to young children warning them about the viscous hits, attacks, fights etc. Finally preventative measures for spectators will include providing safe and secure entrance/exit points for officials, players, and coaches, having the Code of Conduct packet for players and spectators, educating the officials and event staff for handling violent behavior, strategically placed â€Å"wet† areas, signage reminding spectators what they represent, development and implementation of national rules and limiting alcohol and # of spectators. Immediate measures for audience violence would include removal the violent spectator from the event, removal of players from the contest, cancelling the event before it gets out of hand, having a red and yellow card system and having police presence.
